City Council Meeting Minutes March 14, 2024 4. ORDERS, ORDINANCES, RESOLUTIONS AND MOTIONS OF MEMBERS 4.1. By Councilor Ewen-Campen and Councilor Burnley Jr. That the Administration collaborate with this Council to draft a zoning ordinance to remove the requirement to build unnecessary new parking spaces. Resolution (ID # 24-0325) Councilor Ewen-Campen thanked the Administration for partnering in this effort and pointed out that the proposal is easily misunderstood, i.e., many people believe that this would eliminate parking spaces. He made it clear that this ordinance does not get rid of parking and would help to somewhat alleviate the traffic problems experienced in the city. Councilor Ewen-Campen continued, saying that a prime reason for the city’s traffic problem is because the city allowed large companies to build parking garages here and he believes that removing mandatory parking minimums could help. The city’s current zoning sets certain requirements to build parking in some areas while essentially forcing unnecessary parking to be built, as well. Language will be submitted to address this and to get the ball rolling on this matter. Councilor Burnley commented that the city has been pushing on several issues, including making sure that streets are safe, and removing mandatory regulations for parking and driveways makes it better for those who have projects and allows more freedom to operate and build the community we want to live in. He sponsored Director of Mobility Brad Rawson and Devin Matte to address the Council. Mr. Matte stated that parking minimums are terrible in many ways and hurt communities by impacting housing costs through additional rent costs and noted that adding a garage to an apartment reduces its value. Director Rawson told the Council that the city supports this proposal, adding that the zoning overhaul left some unintended consequences and the city is eager to right-size parking. He said that case by case negotiations distract staff from their work. Councilor Scott said this is the right time for this and he looks forward to having minimum parking requirements eliminated. Councilor Ewen-Campen said that he and Councilor Burnley will work on proposed language, and he assured everyone that there will be a public process. Councilor Davis asked about moving some mobility concepts into an ordinance and Director Rawson responded by saying that a workflow was laid out to Councilors Ewen-Campen and Burnley and that he would defer to OSPCD senior staff for a more detailed explanation. Councilor Davis expressed his concern based on the perspective the city has now and he thinks that the changes can be accomplished through the normal zoning process. Councilor McLaughlin said he is also concerned when he hears “process” and thinks it might just need a few words to be changed in the current zoning. He was also curious if the ‘no parking permit rule’ would apply here. Councilor Burnley noted that eliminating a mandate does not eliminate existing parking. Councilor Strezo asked if disability advocates Page 4 of 64
City Council Meeting Minutes March 14, 2024 were involved in discussions of this matter and Director Rawson replied that presenting this item is just the first step. Councilor Strezo asked Councilor Ewen-Campen the same question and he responded by saying that he has not had direct conversations with ADA but he looks forward to doing so. Councilor Strezo requested that the Land Use Committee meet as a Committee of the Whole when conducting a public hearing on this matter, as she wants to make sure there is enough ADA parking and that nobody is disenfranchised. By Councilor Wilson, Councilor Clingan, Councilor Ewen-Campen and Councilor Burnley Jr. That the Administration and the Director of Capital Projects, in conjunction with the Somerville Public Schools, update this Council on the scope and costs involved to renovate the basement of the Edgerly School to reunite the Winter Hill Community Innovation School community under one roof, the relevant state and federal laws triggering required compliance with the Americans with Disabilities Act, and the decision-making process around the timeline for proceeding with this work. Resolution (ID # 24-0341) Councilor Wilson said that the work at the Edgerly School, to accommodate Pre-K and Kindergarten students, might have to be delayed. He asked that the WHCIS community trust that the city is trying to accommodate them, and to that end, he would like to see a transparent process. He sponsored a WHCIS parent, Inez Santos, to address the Council. Ms. Santos said that it’s been hard dealing with the current situation and that now parents are being told that Pre-K and Kindergarten classes might be separate from the rest of the school. She has heard of a proposal to transfer out of the WHCIS, but she is not ready to give that up. Ms. Santos continued, saying that there are after-school classes at other schools, but none for the WHCIS, adding that the City Council needs to look at the pervasive inequities that exist. She would like the Office of Racial and Social Justice to look into this and she would like the city to figure out how to do the renovations this summer. Committee Report (ID # 24-0248) Councilor Davis summarized the actions taken by the committee and spoke about the 2023 Surveillance Technology Annual Report and the public’s ability to file a complaint about or access surveillance data. He noted that these annual reports are not subject to City Council approval, however, there is an ordinance that allows the Council to take up an ordinance to prohibit a particular use. Councilor Burnley spoke about Shot Spotter and the process for filing a complaint and noted that he could not find this information on Page 11 of 64

The city doesn’t have funds to subsidize tuition costs, but it can advocate for those who can’t afford a private education. This resolution is in support of a bill at the state house that addresses some of the problems of providing higher education for all. Councilor Burnley Sponsored Jim Kaplan and Shana Berger to address the Council. Mr. Kaplan, a city resident and member of the MTA, explained how this subject fits into history and how this bill is an effort to offset historic trends of educating those who can afford it. Ms. Berger, a city resident and Adjunct Professor at Bunker Hill Community College spoke about funding for public education, noting that there was a 31% reduction in funding since 2001. This bill seeks to improve working conditions for staff while serving a more vulnerable population. Councilor Sait ran down a list of the benefits to be realized by passage of the bill and she sponsored Vincent Bucourt, Freshman at Somerville High School and Dayshawn Simmons, Somerville Educators' Union President to address the Council.
