Dino’s Market - Federal Realty (199449)
•
Dino’s Market - Petition (199449)
1.
Public Hearing - 199913 - New Garage License, ABJ Auto Repair The applicant stated
that the prior owner passed away after being in business for 38 years, adding that nothing
would change in the operation of the business. Essentially everything will remain the same
with the exception of a couple of new crew members. The business is located at 91
Marshall Street. The license is for 6 cars inside and 25 car outside on the lot. There are 2
separate properties for parking with one lot for Sarma and the other for ABJ.
2.
Public Hearing - 200009 - New Extended Operating Hours License, Speedway The
applicant was not present for the public hearing. Four residents appeared to oppose the
extended hours, citing issues with trash, drunkenness, loud music and rodents in the
dumpsters. Their feeling is that extending the hours is not in the best interest of the
community. Alderman McLaughlin stated that he was there a year ago to discuss the rodent
problems when the business was owned by HESS, adding that there needs to be a limit on
the hours or the problem will continue.
3.
Public Hearing - 200023 - New Garage License, Intellident The applicants were present
and distributed a document on auto hail repairs. Residents spoke and cited the numbers of
cars on or near the property. An owner of another local auto body shop stated that
Intellident is not playing on a level field, as it offers cash-back to its customers.

Public Hearing - 200101 - Amend Extended Hours, Mr. B The applicant appeared
requesting to extend the operating hours from midnight to 4:00 AM. Two residents
appeared stating there are many trucks in the parking lot and that during the early morning
hours, the truck noise is very loud. Alderman McLaughlin stated the current license is for
the business to be open until midnight, with deliveries for midnight to 2:00 AM. The
company’s website should be changed to reflect the correct operating hours.

Federal Realty Investment Trust were also present. The truck would sell snacks and bottled
drinks and operate from 7:00 Am to 8:00 PM. The applicant is also considering selling
cigarettes. FRIT representatives distributed a petition of 50 signatures opposing the issuance of a

Alderman Connolly motioned for a conditional approval with limited hours of 6:00 AM to 11:00
PM with no outside speakers to be used in and around the gas pumps. Additionally the station is
to be checked weekly by ISD personnel who are to check for evidence of regular bating.
RESULT:
APPROVED
200009: New Extended Operating Hours License, Speedway, 709 McGrath Hwy, Operating
24/7.
Alderman Connolly stated it is very annoying that the applicant did not attend or send a
representative to the meeting and he is very concerned with the lack of maintenance of the
property. The motion was denied for the new extended operating hours.
The committee would like the Director of OSE to look into the EPA regarding digging wells
on the properties of residents.

NOT APPROVED
200023: New Garage License, Intellident, 471 Somerville Ave, 5 autos inside, 6 outside, auto
body work only, M-F 8AM-6PM, Sa-Su by appointment only.
Alderman Heuston reported that the business did not request a license and was operating without
one until she had ISD close them down. The worst problem is the ad about the cash-back. There
is much research that needs to be done about this company. Alderman Connolly stated that the
business disrespected the city by not contacting it before opening for business.
Alderman Heuston’s motion that the Supervisor of Inspectional Services take steps to have the
site of Intellident’s business, located at 471 Somerville Avenue, vacated within one week, was
approved.
RESULT:

200101: Amending Extended Operating Hours License, Mr. B's, 142 Cross St, seeking to
remain open to 4AM, 7 days/week.
Alderman Connolly’s motion that the Supervisor of Inspectional Services routinely inspect the
site to ensure that the business is not operating after midnight, was approved.
