Approval of the March 23, 2017 Minutes RESULT: ACCEPTED PUBLIC HEARING: on the petition of On the Hill Tavern, for a Billiards and Bowling License at 499 Broadway (203352) COMMENTS - Current Meeting: No comments were received on this item. RESULT: CLOSED [UNANIMOUS] AYES: Dennis M. Sullivan, Maryann M. Heuston, John M. Connolly 201808: That the Supervisor of Inspectional Services inspect 39, 45, and 47 Webster Avenue for building code compliance and for the capacity for vehicles at each location, both inside and outside the buildings, and report the findings to the Committee on Licenses and Permits. RESULT: WORK COMPLETED 202042: Public Event Permit, Hudson St Neighborway, Sep 3, 8AM-5PM.

Licenses and Permits Committee Page 2 of 4 Printed 5/11/2017 Mr. Chase of Neighborway said he will reach out to neighbors in the future, adding that he would have reached out to every abutter if he knew of the concern. He will submit a design of a mural in the future to get neighborhood input and support. Ms. Connor said the administration supports Neighborway, adding that the city will help to facilitate the process to move it forward. Alderman Connolly recommends that the neighborhood coming up with alternative designs, have a block party and get public input. Alderman Niedergang said that Alderman Connolly’s suggestion hasn’t worked, as he had previously reached out to the opponents and proposed meetings, but they don’t want to participate. Alderman Niedergang stated that Ms. Connor tried to work with a mediator, however, Ms. Amaral didn’t want to reconcile. Alderman Niedergang doesn’t want to continue the process and he wants the BOA to approve the permit and bring it back to the neighborhood where it belongs. Alderman Connolly wants to see the neighborhood united and said that he had discussions with Ms. Amaral and she expressed interest in seeing designs. Alderman Heuston wants to vote on this item tonight and said that a vote tonight doesn’t preclude anything from happening in the future. She queried if there is any reason to speak to the law department, pointing out that the BOA may only grant an occupancy permit. Alderman Sullivan asked Mr. Chase about the crosswalk being painted the wrong color and was told that the city can ignore federal standards if they perform their own safety studies. The city will paint the crosswalks anyway. Alderman Sullivan said there were errors in the process and that it’s sad that it split the neighborhood. He said the BOA relies on city staff to provide information on issues. He wants the BOA to resolve that the mural be redone. Alderman Connolly said that an interim approval was granted and that process is usually only used in an emergency. He wants people to be aware that there was a lack of process from day one. Chairman Sullivan’s proposed Resolution requesting that the applicant redo the mural was unanimously approved. This item was approved by a vote of 2 in favor (Chairman Sullivan and Ald. Heuston) an 1 against (Alderman Connolly). RESULT: APPROVED 202810: That the Traffic and Parking Engineer and the Director of Transportation and Infrastructure inspect 39 Webster Avenue to determine if the driveway there is legal, and report back to the Committee on Licenses and Permits. Licenses and Permits Committee Page 3 of 4 Printed 5/11/2017 RESULT: PLACED ON FILE 202811: That the Superintendent of Inspectional Services inspect 47 Webster Avenue with the property owner to determine the number of businesses operating there, and report back to the Licenses and Permits Committee. Mr. Aurilio reported that he found a discrepancy at the used car lot at 39 Webster Avenue in that there were too many cars at the site and said that he spoke to the operator of the business. Mr. Aurilio stated that he found no problems at 45 Webster Avenue and that there were no issues at JN Phillips. RESULT: WORK COMPLETED 203017: Assistant City Solicitor responding to #202722 re: starting the process to revoke the Lottery Commission License at Winter Hill Market. Mr. Grossfield showed the committee a letter he drafted to the lottery commission. Alderman Connolly said this is not something that happens very often and asked that the letter be amended to stress that fact and because it is a serious matter. This business has had many code violations and the problem has been ongoing and has not yet been resolved. Additionally, Alderman Connolly would like the letter to state that the city will be happy to provide information on the history of the chronic violations. RESULT: APPROVED AS AMENDED 203052: That the Administration re-examine the annual race routes through Davis, Teele and Powder House Squares and report to this Board’s Committee on Licenses and Permits. Ms. Connor said the permit process is on CitizenServe and that Jackie Rossetti is the point person. The goal is to plan routes so that no particular part of Somerville bears the brunt of them. Race routes will be spread and routes will be reversed to lessen the burden. Mr. Long told the committee that a neighbor complained that the establishment advertises that they are open until 4:30AM. The applicant was present and told the committee that the online sites Foodler and GrubHub had listed the wrong hours and that the error has been resolved. RESULT: WORK COMPLETED
