That, the Mayor’s request for approval of the City Council to make an appropriation of $817,000 for the costs of site preparation, professional fees, and planning for the implementation of a Demonstration Plan by the Somerville Redevelopment Authority in connection with property located at 90 Washington Street in the City of Somerville, acquired for the purpose of constructing a new public safety building and/or redevelopment thereon including all costs incidental or related thereto, and authorizing the Mayor and the City Treasurer to issue not exceeding $817,000 bonds of the City to meet said appropriation and pending the issuance thereof the making of temporary borrowings for such purpose is hereby approved, and further, that the Mayor and the City Treasurer are the officers authorized to issue and sell said bonds or bond anticipation notes in accordance with the provisions set forth herein and in Chapter 121B of the General laws of Massachusetts or any other enabling authority. Any premium received by the City upon the sale of any bonds or notes approved by this order, less any such premium applied to the payment of the costs of issuance of such bonds or notes, may be applied to the payment of costs approved by this order in accordance with Chapter 44, Section 20 of the General Laws, thereby reducing the amount authorized to be borrowed to pay such costs by a like amount. If the bonds are sold by negotiation, the purchase agreement shall be subject to the approval of the Mayor and the City Treasurer, and their execution thereof shall be deemed as conclusive evidence of such approval. Section 3. The City hereby expresses its official intent pursuant to §1.150-2 of the Federal Income Tax Regulations, Title 26 (the “Regulations”), to reimburse expenditures paid
sixty days prior to and any time after the date of passage of this Order in the maximum amount and for the project defined in Section 1 with the proceeds of bonds, notes, or other obligations authorized to be issued by the City. The bonds shall be issued to reimburse such expenditures not later than 18 months after the later of the date of the expenditure or the substantial completion of the project, or such later date the Regulations may authorize.
