CITY OF SOMERVILLE IN THE BOARD OF ALDERMEN: _____________ ORDER OF TAKING WHEREAS, by Order of Taking dated December 8, 1927, recorded with the Middlesex South District Registry of Deeds in Book 5184 at Page 433 ( “Order of Taking”), the City of Somerville took land by eminent domain for purposes of establishing a public way known as Kensington Avenue; and WHEREAS, the Order of Taking failed to specify whether the City was taking the land in fee or by easement; and WHEREAS, the City wishes to establish that the City has fee simple ownership of Kensington Avenue; NOW THEREFORE, BE IT ORDERED that the City of Somerville, acting pursuant to the provisions of G.L. Chapter 79 and all other power and authority to it granted or implied, hereby takes by eminent domain, for the purpose of clearing title, a fee simple interest in the land described in said Order of Taking. The City shall cause this Instrument of Taking to be recorded in the Middlesex South District Registry of Deeds. _________________________________________ Thomas F. Taylor, President
