144053502v.1 AN ORDER MAKING AN APPROPRIATION OF $9,750,000 TO PAY A PORTION OF COSTS ASSOCIATED WITH THE DEVELOPMENT OF CLARENDON HILL PHASE II HOUSING PROJECT AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $9,750,000 BONDS OF THE CITY THROUGH THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT’S SECTION 108 LOAN PROGRAM TO MEET SAID APPROPRIATION Ordered: Section 1. That the Mayor’s request for approval of the City Council to appropriate $9,750,000 to pay a portion of the costs associated with the development of the Clarendon Hill Phase II housing project, including the payment of all costs incidental and related thereto, and authorizing the Mayor and the City Treasurer to issue not exceeding $9,750,000 bonds of the City through the United States Department of Housing and Urban Development’s (“HUD”) Section 108 Loan Program (the “Section 108 Loan Program”) to meet said appropriation, and pending the issuance thereof the making of temporary borrowings for such purposes to meet said appropriation is hereby approved, and further, that the Mayor and the City Treasurer are the officers authorized to issue said bonds or bond anticipation notes in accordance with the provisions set forth herein and in Chapters 44 and 121B of the General Laws of Massachusetts, or any other enabling authority. Section 2. The bonds shall bear such rate or rates of interest as determined by HUD in accordance with the Section 108 Program, as the Mayor and the City Treasurer shall approve. They shall be payable from the proceeds of the City’s Community Development Block Grant entitlements and each of the bonds shall recite that every requirement of law relating to its issue has been duly complied with and that such bond is within every debt and other limit prescribed by law. Said bonds shall be sold by the City to HUD and shall be issued in such form as shall be required by HUD’s Section 108 Loan Program. Section 3. The Mayor and the City Treasurer and any other appropriate official of the City as may be required by HUD are hereby authorized, on behalf of the City to submit an application for a loan through the Section 108 Loan Program, and to execute and deliver such documents and enter into all such agreements or otherwise provide such covenants, assurances and certificates for the benefit of HUD, as may be necessary, appropriate or desirable to effect the transaction authorized by this Order.
