Troutman Pepper Locke draft 04-06-26 AN ORDER AMENDING A PREVIOUS ORDER APPROVED BY THE CITY COUNCIL ON FEBRUARY 26, 2026 AND APPROVED BY THE MAYOR ON MARCH 3, 2026, WITH RESPECT TO THE CONSTRUCTION OF A NEW ACCESSIBLE PLAYGROUND AT THE KENNEDY SCHOOL Ordered: Section 1. That Section 1 of the order approved by the City Council on February 26, 2026 and approved by the Mayor on March 3, 2026 with respect to the construction of a new accessible playground at the Kennedy School (the “Order”), is hereby replaced in its entirety to read as follows: Section 1. That the Mayor’s request for approval of the City Council to appropriate $3,000,000 to pay costs of designing and constructing a new accessible playground at the Kennedy School, and for the payment of all costs incidental and related thereto, is hereby approved, and to meet this appropriation, (i) $1,400,000 shall be transferred from available Community Preservation Act funds, and (ii) the City Treasurer, with the approval of the Mayor, is authorized to issue not exceeding $1,600,000 bonds of the City, to be repaid, in the first instance from Community Preservation Act funds, under and pursuant to G.L. c. 44B, or any other enabling authority, and pending the issuance thereof the making of temporary borrowings for such purposes to meet said appropriation, is hereby approved, and further, that the Mayor and the City Treasurer are the officers authorized to issue and sell said bonds or bond anticipation notes in accordance with the provisions set forth herein and in Chapter 44 of the General Laws of Massachusetts or any other enabling authority. Section 2. Sections 2 through 5 of the Order remain unchanged and in effect in their entirety.
