City Solicitor Present 191649 - Requesting an amendment to Ordinance 1-11(b) regarding penalties for violations of Commercial Trash and Cutting of Grass on Sidewalks ordinances.: Mr. Nuzzo reviewed the changes to the fine structure and discussed how a determination that a violation exists will be made. Alderman Trane’s motion to amend the fine structure to $25 for the 1st offense, $35 for the 2nd offense and $50 for the 3rd offense, was approved. RESULT: APPROVED AS AMENDED 191654 - Requesting an amendment to Ordinance 1-11(b) regarding the Traffic and Parking Regulations penalties for violations for Expired Vehicle Registrations and Inspections.: Alderman Sullivan was recused from this portion of the meeting. Mr. Dias explained the proposal and assured the members that efforts would be taken to advise residents of this new policy in advance of its implementation. It has been projected that these new fines would bring in approximately $940,000 per year. Mr. Dias noted that there was a

Mr. Grossfield told the members that since state regulations don’t mention these offenses as moveable offenses, they would not be surchargable. Deputy Police Chief Upton stated that the city collects $20,000 to $30,000 per month as its share from the state as a result of moving violations. Since these new fines would not be for moving violations, the city is entitled to retain the full amount of the fines. Alderman Trane requested clarification as to whether the offenses would be surchargable, if written by a Parking Control Officer. RESULT: APPROVED
