BE IT ORDAINED: By the City COtlncil of the City of Medford that Clwpter 38 of the Revised
the Ordin<lnces ot'the City of Medford. be amended by enacting <l new section entitled "Section
38-3 T entitled "Nuis<lnce Control", cOIH<lining the follo\.ving language:

Purpose
In order to protect the health, safety, and welt~He of the inhilbiWllts of the City of MeJforcl, this
ordinance sl1811 permit the City to impose liilbility on Property Owners <lnd other responsible
persons for the nuisances and harm caused by loud ;llldior u1ll'ulv Gatherings on private propelty
and shall prohibillhe constllllptioll ofalcnholic hever<lges by lIncler<lgc persons at such
Gatheri ngs.

Definitjons
Eviction means actively trying to evict a tcnilnt 1'1'0111 a premise by delivery 01' a notice to qtlit and
subsequent court proceed ings. if a tenant fa iIs to vaciltc the Pre III ises.

Gathering is a party or event where two or 11101't' persons have a~<;elllbleJ or are assembled for a
social occilsion or sociill <lctivity.
Premises means any residence or other private propel'll'. place. PI' location. including any
cOlllmercial or business propel1Y.
ProjJertv Owner means the legal owner ofrecord ofa Premises ,lS listed by the tax assessor's
records.
Puhlic Nuisance means a Gathering of persons on :-IIlY Premises in <l manner which constitutes (]
viol<ltion of law or creates a substantial disllIrbance of the quiel enjoyment 01' private or public
property in n neighborhood. Behavior constituting a Public Nuis:-lnce includes. but i.~ not limited
to cxcessi \Ie noise <lnd excessive pedestrian and veh icular tra fric rclalcd thereto, obstruction 0 f
public ways or sidewalks by crowds. vehicles. trash (lr refuse. illegal parking. public urination.
the service of alcohol [0 underage persons. public consumption of alcohoL lighting, disturbances
of the peace, ancllittering.
Re.\'{Jonse Costs are the costs associated with response~ by law enforcement. tire, and other
emergency response providers to a G8thering which has resulted in a Public Nuisililce as set forth
in a schedule of costs est<lblished by the City Council.
