Attorney Alfred Farese, representing the applicant, stated that the city's zoning ordinances do not
mention fortune telling businesses, therefore, regulation would be by the state, and to deny the
application would be unconstitutional. Mr. Shapiro explained that the Planning Department is
working out the zoning allowance for the proposed use and he discussed the relationship between

the licensing and zoning aspects of this application. Alderman Trane expressed his concern
regarding the applicant's reputation and experiences in other communities.
The application was approved with the following conditions:
1. license is subject to the pending review and approval of the Planning Department,
2. hours of operation shall be 9:00 AM - 9:00 PM Monday - Saturday and 10:00 AM - 6:00 PM
on Sunday,
3. no residential living activity permitted on premises, only business activity allowed.

autos.:
Mr. Nuzzo discussed his review of the property and informed the members that since 1960, the
Dilboy Post has been donating 15 parking spots to the Somerville Police Department for use
during shift changes and that the use is grand-fathered. Mr. O'Shea cited statutes that he believes
are being violated and Claudia Morrow expressed concern that the city is being secretive and
clandestine with regard to this matter and feels that the city should be receiving payment from
the Post for operating a parking lot. Mr. Shapiro offered his opinion that the license may be
approved conditioned on compliance with the law.
The item was approved with the condition that all applicable laws are complied with.

192319 - That the City Clerk notify the holder of the license for G E Auto Repair to appear
before the Committee on Licenses and Permits to discuss the terms of the license.:
The proprietors of Mass Auto Brokers and GE Auto Repair appeared before the committee to
discuss the parking and storage of vehicles at the respective businesses. Since both businesses
share a common address, both of the previously approved licenses (item # 191208 and 192089)
were amended, as follows:
GE Auto Repair (#191208): 0 vehicles outside, 9 vehicles inside
Mass Auto Brokers (#192089): 4 vehicles outside, 5 vehicles inside
