1 CITY OF SOMERVILLE IN THE BOARD OF ALDERMAN: ______ AMENDMENT TO LAYOUT AND ALTERATION ASSEMBLY SQUARE DRIVE AND IKEA WAY WHEREAS, The Board of Alderman and the Mayor of the City of Somerville, Middlesex County, Massachusetts, did, under date of January 14, 2010 alter, lay out as City ways, roads known as Assembly Square Drive and IKEA Way, as shown on the plans of said City ways on file in its office, in the office of the City Clerk of said City and recorded with the Middlesex South Registry of Deeds in Book 54179, Page 325 (the “Order of Taking”) and WHEREAS, the descriptions of said layout and alteration of Sections 1 and 2 of the layout and alteration require an amendment due to design changes subsequent to the Order of Taking; WHEREAS; it is deemed necessary to amend the said Order of Taking; NOW, THEREFORE, it is hereby ordered that said Order of Taking be amended by striking out, Pages 1 through 5, and substituting therefore the following: NOW, THEREFORE, acting under the authority of Chapter 82 of the Massachusetts General Laws and acts in amendment thereof and in addition thereto, the City of Somerville adjudges that public necessity and convenience require said City should alter the location of said City ways in three sections and should lay out and take charge of said City ways as altered as hereinafter described.

5 SECTION 3 The third section of city way hereby altered and laid out provides a location for the widening of a portion of Assembly Square Drive on the westerly side thereof at its intersection with Mystic Avenue and is bounded easterly by Assembly Square Drive, southerly by Mystic Avenue and by the following described line: Beginning at a point on the northeasterly street line of Mystic Avenue, about 4 feet from the northwest intersection of Mystic Avenue and Assembly square Drive and extends thence, N 46°28’25” E 80.35 feet; thence N 3°33’06” E 94.35 feet to the point of ending thereof, said point being on the westerly street line of Assembly Square Drive. The locations of the sections of city ways altered and laid out as hereinbefore describe are to be further defined by bounds set thereon at angle points, points of curvature and at the points of beginning and ending thereof, where feasible. For the purpose laying out, constructing and maintaining the sections of city ways hereinbefore described, the Board of Aldermen and the Mayor, on behalf of the City of Somerville under the provisions of Chapter 82 of the General laws, and all other general or special laws thereto enabling, do hereby take in easement and layout as a public way, those parcels of land shown on the plan hereinafter referred to as Parcels E-1, E-2, E-3, E-4A, E-4B, E- 4C, E-5 and E-6. The city ways hereby laid out and altered are shown on a plan prepared by Vanasse Hangen Brustlin, Inc. dated January 13, 2011, which is recorded herewith and entitled:

6 “PERMANENT HIGHWAY EASEMENT AMENDED PLAN OF LAND ASSEMBLY SQUARE DRIVE FOLEY STREET & IKEA WAY IN THE CITY OF SOMERVILLE, MASSACHUSETTS MIDDLESEX COUNTY SCALE: 1” = 80 FEET” IT IS THEREFORE ORDERED: that an easement for roadway purposes be and hereby is taken in Parcels E-1, E-2, E-3, E-4A, E-4B, E-4C, E-5 and E-6, and that said city ways as laid out and altered, as described herein, and as described and shown on said plan, be and the same are hereby laid out and taken charge of by the City of Somerville.
