DRAFT 2-14-13 - 1 - CITY OF SOMERVILLE ORDINANCE NO. _________ IN THE BOARD OF ALDERMEN: ______ AN ORDINANCE AMENDING THE SOMERVILLE ZONING ORDINANCE SECTION 7.11.9.2 TO SEPARATE SUPERMARKET FROM GENERAL MERCHANDISE AND DEPARTMENT STORE IN THE USE TABLE AND SECTION 2.2 TO ADD DEFINITIONS OF THESE USES. WHEREAS, general merchandise and department stores have different neighborhood impacts than supermarkets; and, WHEREAS, providing access to fresh foods is a priority and an action item in the SomerVision Comprehensive Plan; and, THEREFORE, be it adopted by the Board of Aldermen, in session assembled, that the below listed sections of the Somerville Zoning Ordinance are hereby amended as identified. 1. Article 2: Section 2.2, Definitions are hereby amended as follows (additions are underlined and deletions are struck): 2.2.164.1 Supermarket. An establishment whose primary business is the sale of a general line of food, such as fresh fruits and vegetables, fresh and prepared meats, fish and poultry, and canned and frozen foods, with none of the lines predominating. The floor area devoted to the sale and storage of food comprises at least 75% of the gross floor area of the establishment. 2.2.61.a General merchandise establishment. An establishment whose primary business is the sale of a general line of new merchandise, such as apparel, automotive parts, dry goods, hardware, groceries, housewares or home furnishings, and other lines in limited amounts, with none of the lines predominating. 2. Article 7: Section 7.11.9.2, Table of Permitted Uses are hereby amended as follows (additions are underlined and deletions are struck):
